Recruiters and the Coronavirus Job Retention Scheme

We are awaiting further information from government in relation to the Government’s planned job retention scheme / furloughing workers receiving 80% income.

 We are hoping that the job retention scheme will be applicable to umbrella, but we do not actually know for certain at this stage.

European Court Rules That Employers Must Track Worker Hours

In a new ruling that could affect agencies and other employers, The Court of Justice of the European Union (CJEU) has confirmed that employers need to have systems in place to accurately record hours worked by a worker each day.

In a case between the Federación de Servicios de Comisiones Obreras (CCOO) and Deutsche Bank SAE, the court ruled that employers need to have records of hours worked to ensure compliance with the Working Time Directive.

Treasury: 2019 Loan Charge Will Go Ahead Despite Appeals

The Treasury has confirmed that the 2019 Loan Charge will take effect this week, despite appeals from MPs, members of the House of Lords and Loan Charge campaigners.

HMRC released a last-minute statement on Wednesday, reminding Loan Scheme users that they have an obligation to pay the tax owed.

The statement urged users of disguised remuneration schemes to come forward and settle their debts by April 5. The tax authority also said that ‘flexible’ payment options are available to those that worry they will not be able to pay.

 

The Construction Industry’s New VAT Headache

The Chancellor’s most recent Budget contained new measures to combat VAT avoidance by companies in the UK.

As part of the Treasury’s strategy to combat ‘missing trader’ VAT fraud, contractors in the construction industry will have to grapple with confusing changes to the VAT system that could affect their cashflow.

HMRC Wins Case Over Contractor Loan Scheme

HMRC has won a tribunal case against a contractor loan scheme promoted by Hyrax Resourcing Ltd.

Hyrax Resourcing will now be forced to disclose the details of 1,180 ‘high earners’ that use the scheme and help the tax authority claim back more than £40 million in unpaid taxes.

The scheme in question was a disguised remuneration tax avoidance scheme that paid users in loans so that they could avoid paying income tax and National Insurance contributions on their earnings.
